On behalf of our partners, Blackburn with Darwen Borough Council, we are pleased to offer for sale by way of building licence this compact and manageable development opportunity located at the Northern gateway to Darwen Town Centre.
The Property commands a prominent junction between Bury Street being the new main route of A666 Blackburn to Bolton road; and the one way vehicular access along Duckworth Street into Darwen Town Centre being the original line of the A666.
The Property comprises the remaining parts of the site of a former demolished and permanently decommissioned petrol filling station, and is now surplus to the Council’s requirements following completion of highway improvement works to re-align parts of the adjoining Duckworth Street and Bury Street.
LOCATION
The main site frontage is to Duckworth Street being part of Darwen Town Centre’s retail core. The Property benefits from extensive free public car parking in newly created herringbone car parking bays along Duckworth Street, and in nearby public car parks elsewhere in Darwen Town Centre.
Darwen has benefited recently from massive investment. The town’s new £12.7M Leisure Centre opened in January 2010 is within 100M of the site. The new £49M Darwen Aldridge Academy School is within 500M of the site.
The site is highly visible to traffic on the A666 (one of the busiest ‘A’ roads in the North West), yet the recently re-engineered road network has taken through traffic along the adjoining Bury Street creating a calmer environment on the main Duckworth Street frontage. It might be said that the Property now has ‘best of both worlds’ - a prominent ‘A’ road frontage, and the access convenience of a local distributor with frontage public parking.
ACCOMMODATION
Reasonably level cleared site of a former demolished and permanently decommissioned petrol filling station now used temporarily for overspill informal public car parking.
The former petrol filling station has been professionally permanently decommissioned under the supervision of Capita Symonds Structures, with all petroleum storage tanks and associated equipment having been removed from site, soil samples taken, and voids filled by imported clean material. The work was completed in February 2008. The full remediation validation report is available for viewing by arrangement.
Current access is from Duckworth Street only. The Property is at a generally lower level than the adjoining Bury Street and Varley Street with retaining walls to those adjoining highways. The purchaser will be required to construct new retaining walls on the Varley Street Frontage to accommodate future highway improvements.
Nett site area edged red on the attached Site Plan - 0.0884 Hectares (0.218 Acres) or thereabouts subject to survey.
PLANNING & USE
The Property is considered suitable for a mixed use redevelopment.
It is likely that any planning consent will contain an obligation to enter into an agreement under s106 Town and Country Planning Act 1990 relating to the proposed improvement of Varley Street. It is likely that the terms of such agreement will require the applicant to make a capital contribution towards implementation of the proposed works. Any contribution required up to a maximum of £30,000 will however be deductable from the price finally payable.

TENURE & TERMS OF DISPOSAL
The Property is offered by way of a contract for the grant of a building licence for a period of 2 years conditional on the successful party (1) applying for planning permission for a pre-agreed form of development within 6 months and (2) obtaining acceptable planning consent for that development within 12 months of the contract date.
The Building Licence will include the land edged red and shaded blue on the Site Plan and will allow the licensee to purchase a sublease of the land edged red at a premium for a term ending on 6 May 2823 at a rent of £50 p.a. The Sublease will be granted out of the Council’s Leasehold interest held under registered title LA387328 subject to completion of the development in accordance with the approved plans.
The Sublease will contain reservations over the land shaded brown on the Site Plan for future inspection and maintenance of the highway retaining wall to be constructed by the Purchaser. The extent of the reservations may be reduced if the retaining wall becomes incorporated into the structure of buildings on the site.
Full heads of terms for the building licence are available on request. Interested parties are required to have provisionally agreed heads of terms (with the exception of the purchase price) with Capita before submitting offers.
COMPLETION
The successful party will be required to exchange conditional contracts within eight weeks after notification of acceptance of an offer.
PRICE
Offers in the region of £170,000 (one hundred and seventy thousand Pounds), subject to contract, will be invited being the total purchase with a non-refundable building licence fee of 10%, followed by payment of the 90% balance on completion of the purchase of the Council’s interest.
COST
Successful party to pay on exchange of conditional contracts a contribution to the Council’s legal and surveyor’s costs of 2% of the total offer price subject to a maximum of £3,400 ex VAT. Amount paid on exchange to be credited against the building licence fee, but is not otherwise refundable.
