4.71 acre residential development site in Monkerton, Exeter for sale by informal tender. Land with resolution to grant outline planning application for up to 80 units (Exeter City Council Ref No. 18/1145/OUT).
Location
Tithebarn Way lies to the east of the city centre adjacent to Cumberland Way and the site is in the heart of the new residential development at Tithebarn Green and Monkerton.
Local facilities are located to the north in Pinhoe and the Sainsbury?s and Aldi supermarkets on Pinhoe Road. The site is well served by the bus routes along Cumberland Way and Pinhoe Railway Station providing quick access to Exeter City Centre. Junction 29 of the M5 motorway lies to the south of the development site and gives easy access to the trunk road network. Exeter Business Park, the Met Office campus and Exeter Science Park are major employment areas close to the site.
Description
The land is currently urban greenfield land which was formerly part of Monkerton Farm.
The development site of 1.906ha (4.71 acres) will be accessed from the Tithebarn Lane Link Road (now known as Tithebarn Way) and is shown edged red on the plan P.147/3(15).
Under the terms of the sale agreement the development on this site will be restricted to 80 residential units.
The land to the south of the site to Hollow Lane has transferred to Exeter City Council as public open space to form part of the Monkerton Ridgeline Park.
Planning
An application for outline planning permission has now received a resolution to grant planning permission for a residential development of up to 80 units, (Exeter City Council Ref No. 18/1145/OUT). A draft Decision Notice has been produced and the s106 Agreement is under negotiation.
Interested parties are advised that the Vendor was intending to commission archaeologists to undertake work to satisfy condition 22 of the draft decision notice but this can be discussed further with the purchaser.
Historic Planning Information
The historic planning permission (13/4984/01) is subject to the provisions of a S.106 Agreement dated 12th June 2015 together with agreed Deeds of Variation dated 27 October 2015 and 17 May 2018. The historic planning permission also covers additional land to the west of Cumberland Way and to the south of Hollow Lane.
Devon County Council, as landowner, has discharged the provisions concerning the Monkerton Ridgeline Park in Schedule 2 and the Traffic Regulation Order Contribution in Schedule 4 of the S.106 Agreement (as amended).
The Highway Works listed under Schedule 3 of the S.106 Agreement (as amended) are the responsibility of the developer (Taylor Wimpey) of the land to the west of Cumberland Way.
Condition 7 of the historic planning permission requires that a phasing plan is submitted to and approved in writing by the local planning authority. This has been actioned to split the land covered by the historic planning permission into four distinct areas:
Land adjoining Tithebarn Lane Link (now known as Tithebarn Way)
(Red Land - the development site referred to in these sales particulars)
Land at College Way (Pink Land)
Land to the west of Cumberland Way
Please note that it does not, in itself, set an order nor a timetable for the development for each of the parcels.
Historic Planning Information Cont)
There is a further Supplemental Agreement dated 07 January 2019 to the S.106 Agreement under ECC Ref 18/0683/FUL, which was completed in connection with the sale of the Pink Land. This does not directly affect the development site (known as the Red Land).
Condition 19 of the historic planning permission required that one of three options on the highway network is open to traffic before any occupation of the residential units occurs. The opening of the Tithebarn Lane Link Road (now known as Tithebarn Way) and the route through the Exeter Science Park satisfies this condition. As a consequence it is not anticipated that the Council (ECC) will require this as a condition in relation to the current outline application (18/1145/OUT).
Condition 28 of the historic planning permission and Schedule 5 of the S106 Agreement refer to the district heating system ("DHS") proposed for all the major Monkerton area developments. DCC as landowner has signed the Master Agreement dated 9 November 2015 for the procurement of the DHS with EoN and this will bind this site.
As and when ECC grants planning permission for the current application (18/1145/OUT), they will require DCC as landowner to enter into a S.106 Agreement (currently under negotiation).
For information purposes only, the historic planning permission has been varied by 17/1314/NMA and 18/0869/NMA and reserved matters granted in respect of the Taylor Wimpey development on land to the west of Cumberland Way (18/0010/RES)
VAT
Interested parties are advised that the Vendor have confirmed (where they are able and not required by law) they will not take any steps to waive the exemption from VAT in respect of the land prior to completion of the purchase.
Technical
It is understood that connections to gas, water and electrical supplies are available within the adopted highways of Tithebarn Way and Cumberland Way with foul water drainage in Pinn Lane. Purchasers should rely on their own investigations about the suitability of such connections.
Tenure
The development land is available freehold with vacant possession on completion.
Rights of Way
The sale is subject to all rights of support, public and private rights of way, water, light, drainage and other easements, quasi-easements and wayleaves, all or any other like rights, whether mentioned in these particulars or not.
Directions
From the M5 at Junction 29 follow the signs to Exeter to the Moor Lane roundabout, take the third exit onto Ambassador Drive towards the Exeter Business Park. Continue towards the University and Pinhoe onto Cumberland Way taking the second exit at the third roundabout onto Tithebarn Way. The land is then immediately on the right.
